You need to check with your local code enforcement for buildings. It is part of the local town or city government.
Way to vague. Generally fences should be about 2′ in the ground. There probably are no regulations. The court is likely to say something to the effect that ‘When there is no regulation, you must use your best judgement to keep it safe.’ It fell so you, or your installers, best judgement was insufficient. You should be looking at the person you purchased the home from if the fence was already up.
God Bless
A FENCE THAT HIGH SHOULD HAVE BEEN SECURED WITH POST’S, THAT HAVE BEEN DUG IN AT LEAST TO A DEPTH OF 18 TO 24 INS.IF YOU ARE THE OWNER OF THE FENCE IT’S YOUR RESPONSIBILITY ,TO MAKE SURE IT’S SAFE.
In addition to the information below, fence posts (4×4′s) are usually installed at 8′ on center and about 2′ deep.
